By accessing or using WizardToad's services, you agree to be bound by these Terms of Service. If you disagree with any part of the terms, you may not access the service.

2. Description of Service

WizardToad provides AI-powered financial news analysis and insights. The service:

• Aggregates and analyzes publicly available YouTube video content about financial topics
• Uses artificial intelligence (via OpenRouter API) to generate summaries and insights
• Delivers personalized notifications via Telegram (optional)
• Provides a chat interface to discuss summaries with an AI assistant

3. User Accounts

When you create an account with us, you must provide accurate and complete information. You are responsible for:

• Safeguarding your account password and keeping your account information secure
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account

We reserve the right to refuse registration or terminate accounts at our discretion, particularly in case of abuse or violation of these terms.

4. Acceptable Use

You agree not to use the service to:

• Violate any applicable laws or regulations
• Infringe on intellectual property rights of others
• Transmit any harmful, threatening, abusive, or harassing content
• Attempt to gain unauthorized access to any part of the service
• Interfere with or disrupt the service or servers
• Use automated means (bots, scrapers) to access the service without permission
• Redistribute or commercially exploit our content without written permission

6. Subscription and Payment

WizardToad offers both free and paid subscription plans. Paid subscriptions are processed through Stripe. The following terms apply:

• Subscriptions are billed in advance on a recurring basis (monthly or annually)
• Prices are clearly displayed before purchase, including VAT where applicable
• You may cancel your subscription at any time through your account settings
• Cancellation takes effect at the end of the current billing period

7. Intellectual Property

The WizardToad service, including its software, design, and branding, is owned by us and protected by copyright and other intellectual property laws.

The summaries and analyses generated by our service are based on publicly available YouTube content. The original video content remains the property of the respective creators. Our AI-generated summaries represent our own derivative work for informational purposes.

8. Disclaimer of Warranties

The service is provided on an 'AS IS' and 'AS AVAILABLE' basis. To the extent permitted by law, we make no warranties, express or implied, regarding:

• The accuracy, completeness, or reliability of AI-generated content
• Uninterrupted or error-free operation of the service
• The service meeting your specific requirements
• The accuracy of any financial information or analysis

9. Limitation of Liability

To the extent permitted by German law:

• We are liable for damages caused by intent or gross negligence
• For slight negligence, we are only liable for breach of essential contractual obligations (Kardinalpflichten), limited to foreseeable, typical damages
• We are not liable for any financial losses resulting from decisions made based on our content
• Liability for damages to life, body, or health remains unaffected

10. Termination

You may terminate your account at any time by contacting us or using the account deletion feature (when available). Upon termination:

• Your access to the service will cease immediately
• Your personal data will be deleted in accordance with our Privacy Policy
• Any unused subscription time will be handled according to our refund policy

We may terminate or suspend your account immediately for violation of these Terms, illegal activity, or other reasons at our discretion.

We reserve the right to modify, suspend, or discontinue the service (in whole or in part) at any time, with reasonable advance notice where practicable. In the event of a permanent discontinuation of the service, active subscribers will receive a pro-rata refund for any unused portion of their prepaid subscription period.

11. Governing Law and Jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

For consumers within the EU: You may also benefit from mandatory consumer protection laws of your country of residence. Nothing in these Terms affects your statutory rights as a consumer.

EU Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr/
We are not willing or obliged to participate in dispute resolution proceedings before a consumer arbitration board.

13. Changes to Terms

We may modify these Terms at any time. If changes are material, we will notify you by email or through the service at least 30 days before they take effect. Continued use of the service after changes constitutes acceptance of the modified Terms.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
